Indirect costs associated with this project represent a flat indirect rate based upon historical and projected Facilities General and Administrative (FG&A), bear a relationship to this project, and are not covered by other funds. Direct labor is not already paid through annual appropriation to this agency and is included only for staff working on this project directly. Governance: The identified NIAID project officer/point of contact and the DHS/S&T BTCP Program Manager shall monitor the progress of activities conducted under this agreement and solve problems that arise. Unresolved issues will be referred to the Director Office of National Labs at DHS/S&T and the Director of the Division of Microbiology and Infectious Diseases, NIAID for resolution. Publications; Press Releases: Abstracts, manuscripts and other public presentations based on the results of research conducted under this IAA shall conform to the current publication policies of the agencies. If the agencies' publication policies conflict with each other, security considerations will take precedent and the respective POCs for each agency will resolve any additional differences. Individuals employed by either agency, as well as individuals employed by third parties, who meet the customary criteria for authorship, will be included as authors on publications that result from this collaborative effort. The agencies agree that prior to submission for publication, copies of abstracts, manuscripts and presentation materials will be provided to POCs to allow thirty (30) days to review any proposed manuscripts and publication materials and 3 days to review proposed abstracts. The submitting authors will take into consideration any comments from the reviewers. Each agency shall provide a copy of any proposed press release related to the work described in this IAA to the other agency for review and comment at least five (5) business days in advance of the proposed publication date. Intellectual Property: The agencies intend as follows with respect to inventions: The rights to all intellectual property arising from the projects under this agreement will be governed by Federal law. Inventions made by the employees of an Agency should be administered in accordance with the policies of that Agency. The agencies intend to coordinate the licensing of any jointly-owned inventions arising under this agreement. pg. 4
